Scheme Amendment No. 328 - Planning Requirements for Canal Frontage Lots

Standard Amendment No.328 to Local Planning Scheme No.4
The Shire is proposing to introduce a Special Control Area (SCA) into its Local Planning Scheme No.4 (LPS4) to cover lots that directly front the canals in South Yunderup. The SCA will clarify that development approval is required for all development within the SCA, however, exemptions will continue to apply where a proposal complies with the requirements of the relevant local planning policies.
A recent decision handed down by the Supreme Court of WA has highlighted the need to include a SCA within a local planning scheme where development standards are intended to be controlled by local policies. Which has been the case for canal frontage properties in South Yunderup. Essentially this amendment will ensure that there will be no material change to current practice and ensure the protection of the character and amenity of the canal frontages.
General Development Requirements for Properties Abutting an Artificial Canal Waterway Local Planning Policy
In support of the SCA, some minor changes are required to this local planning policy to ensure:
- there is clarity around the definition on what is considered to be a ‘beach’ lot;
- upper floor balconies are consistent with the building setback line;
- that fencing is exempted where it meets the policy standards; and
- that fencing in Yunderup Canals Stage 2 and Yunderup Canals Stage 3 is not required to be open behind the building line.
